Terms of Service

These Terms of Service (the “Terms”) set out the conditions for using the game “RamuneBit”, its online features, and its official website (together, the “Service”), provided by Nayutari (the “Operator”). They apply to everyone who uses the Service (each a “User”).

This English version is a reference translation. The Japanese version is the official text and prevails if the two differ.

Article 1 (Agreement)

  1. Users use the Service after agreeing to these Terms. By launching or using the game, you are deemed to have agreed to these Terms.
  2. Personal information in the Service is handled under the separate Privacy Policy.

Article 2 (Age and Minors)

  1. The Service has no age limit. Please refer to the age rating shown on each store as a guide.
  2. Minors must use the Service with the consent of a parent or guardian. If a minor uses the Service, the consent of a parent or guardian is deemed to have been given.

Article 3 (Accounts)

  1. You use the game’s online features by signing in with the account of the store you got the game from. Your account in the Service is created the first time you sign in. You do not need to register an email address or your name.
  2. Accounts in the Service are separate for each store. If you sign in with the same store account, you can use the same account on another device. Accounts and data cannot be carried over to or from a copy of the game obtained from a different store.
  3. Even if you cannot sign in with your store account, you can still use the features that are playable offline.
  4. You can delete your account at any time from the in-game settings. A deleted account and the data tied to it (including published boards) cannot be restored.

Article 4 (Purchases and Refunds)

  1. The game is purchased through each store (Steam, Epic Games Store, Google Play, the App Store, etc.), and each store’s terms apply.
  2. Refunds follow each store’s conditions and procedures. The Operator does not receive payments directly and cannot process refunds.
  3. The game has no in-game purchases and no ads.

Article 5 (User Creations)

  1. In these Terms, “User Creations” means boards (including thumbnail images and the creator’s run recording), marble paintings, and nicknames that Users create or post in the Service.
  2. Copyright and other rights in User Creations belong to the User who made them (or the relevant rights holder).
  3. Users grant the Operator a free, non-exclusive, worldwide license, without time limit, to use User Creations (including reproducing, publicly transmitting, displaying, and adapting them, and sublicensing to the Operator’s service providers) for the following purposes:
    • Providing, operating, and improving the Service (storing, distributing, displaying to other Users, converting image or data formats, etc.)
    • Promoting the Service (on the official website, social media, videos, store pages, ads, etc.). The creator’s name may not be shown when used for promotion.
  4. Users allow other Users to play and display their published boards within the Service.
  5. Users agree not to exercise moral rights in User Creations against the Operator or other Users.
  6. Users guarantee that their User Creations do not infringe the rights of any third party and that they have the right to grant the licenses in this Article.
  7. Even after you delete a board or your account, the following may remain:
    • Data already loaded on other Users’ devices before deletion
    • Promotional materials made before deletion
    • Backups described in the Privacy Policy (which disappear after a set period)

Article 6 (Criteria for Recommendations)

  1. In places where the User has not chosen a specific board (randomly selected boards, lists of new and popular boards, etc.; “Recommendations”), the Operator shows boards that it judges do not fall under any of the following:
    • Boards containing inappropriate expression (including expression prohibited by Article 7)
    • Boards that may infringe the intellectual property or other rights of a third party
    • Boards that the Operator judges to be theoretically impossible to clear
  2. Boards judged not to meet the criteria above are subject to the measures in Article 8.

Article 7 (Prohibited Conduct)

When using the Service, Users must not:

  1. Violate laws or public order and morals
  2. Infringe the copyright, trademark, portrait rights, privacy, or other rights or interests of others
  3. Express any of the following through boards, paintings, nicknames, or other means:
    • Obscene content, or content that sexually exploits children
    • Excessively violent or cruel content
    • Discrimination, defamation, threats, or harassment
    • Information that can identify yourself or others (name, address, contact details, etc.)
    • Content that encourages crime or self-harm
  4. Undermine fair play, such as by using unauthorized tools or modified versions of the game, or by deliberately exploiting bugs
  5. Have the game played by bots, AI, or other programs without a person operating it (“automated play”). This does not include assistive technologies that support input operation, such as for disabilities.
  6. Decompile, disassemble, or otherwise analyze the game beyond what the law permits
  7. Place excessive load on, gain unauthorized access to, or interfere with the operation of the Service’s servers or networks
  8. Use multiple accounts to inflate reports, or repeatedly make groundless reports
  9. Impersonate the Operator or other Users
  10. Use the Service or User Creations for commercial purposes, such as selling or renting them, without the Operator’s permission (except as allowed by Article 10)
  11. Engage in any other conduct the Operator deems inappropriate

Article 8 (Measures by the Operator)

  1. If the Operator judges that a User Creation or conduct does not comply with these Terms, it may take the following measures without prior notice:
    • Measures on boards
      • Limited exposure: The board is removed from Recommendations. It can still be played from the creator’s list or by specifying its board ID.
      • Suspension: No one can play the board. (The creator can still check the board’s content and the reason for the measure.)
      • Deletion
    • Hiding a painting (other Users see the default marble)
    • Resetting a nickname
    • Restricting account features (publishing boards, changing paintings, playing online, or reporting; for 1 day, 7 days, 30 days, or indefinitely)
    • A warning
  2. When the Operator takes a measure above, it shows what the measure is and why in the game. The Operator decides on measures after reviewing the content; it never takes a measure automatically based only on the number of reports.
  3. If you disagree with a measure, you can appeal as follows. As a result of the review, the measure may change (be lifted, kept, or made heavier).
    • Limited exposure: Appeal from the board’s detail page in the game (once per measure).
    • Other measures: Contact us at the address in Article 11.
  4. The Operator may immediately delete illegal or urgent content without a grace period.
  5. Except as provided in Article 13, the Operator is not liable for any damage to Users caused by measures under this Article.

Article 9 (Online Features and Multiplayer)

  1. In multiplayer, the User who created a room (the host) can remove other participants from the room.
  2. Users can block other Users and boards. Blocked Users’ boards and paintings are no longer shown on your screen.
  3. The game has no chat feature.
  4. Online features may be unavailable depending on your connection or the status of external services (Epic Online Services, Cloudflare, etc.).

Article 10 (Gameplay Videos, Streaming, and Screenshots)

Users are free to post gameplay videos, livestream, and share screenshots of the game, including using the monetization features of video-sharing and streaming services. However, you may not stream or publish automated play (Article 7, item 5) (“automated streaming”). Please also be considerate of other Users when their creations or nicknames appear. The Operator may ask you to stop sharing content when it deems necessary, such as when the content violates these Terms.

Article 11 (Reports, Rights Infringement Claims, and Contact)

  1. Boards and other Users can be reported from within the game.
  2. Claims of rights infringement, reports of illegal content, appeals against measures, and other inquiries are accepted at the contact below. Rights holders can contact us even if they are not Users of the game.
  3. Depending on the inquiry, we may ask you for the user ID shown in the in-game settings, other information, or an in-game action to confirm your identity.

Article 12 (Changes, Interruption, and Termination of the Service)

  1. The Operator may change the content of the Service or interrupt it temporarily.
  2. If the Operator ends the game’s online features, it will announce this on the official website at least 90 days before they end. The Operator will make efforts so that features playable offline remain playable after the online features end.
  3. In unavoidable circumstances, such as natural disasters, failures, or the shutdown of external services, the Service may be interrupted or ended without the notice period above.

Article 13 (Disclaimers and Limitation of Liability)

  1. The Operator does not guarantee that the Service is fit for a particular purpose, free of defects, or always available.
  2. The Operator is not responsible for User Creations or for disputes between Users, or between Users and third parties.
  3. Even where the Operator is liable, except in cases of the Operator’s intent or gross negligence, its liability is limited to direct and ordinary damage actually suffered by the User, up to the amount the User paid to purchase the game.
  4. Notwithstanding the paragraph above, where the Consumer Contract Act or other laws do not allow the Operator’s liability to be limited, those laws apply.

Article 14 (Changes to These Terms)

  1. The Operator may change these Terms when it deems necessary.
  2. When these Terms change, the Operator will post the new content and its effective date on the official website. Changes that are unfavorable to Users will be posted a reasonable period before the effective date.
  3. If you use the Service on or after the effective date, you are deemed to have agreed to the changed Terms.

Article 15 (Governing Law and Jurisdiction)

  1. These Terms are governed by the laws of Japan.
  2. Any dispute relating to the Service shall be subject to the exclusive jurisdiction, in the first instance, of the district court with jurisdiction over the Operator’s address.

Article 16 (Language)

The Japanese version of these Terms is the official text. Versions in other languages are reference translations, and if they differ from the Japanese version, the Japanese version prevails.
